Terms of use

By creating an account or using Swatchee, you accept these terms. They are supplemented by the privacy policy and the cookie policy.

Article 1 — Purpose

These terms of use (the "Terms") govern access to and use of the Swatchee service, published by BeBranded SAS (RCS Bobigny 984 530 212, 34 avenue Chanzy, 93250 Villemomble, France — see the legal notice), which lets you build a skin profile, browse reviews filtered by profile, scan and collect products, and interact with other users.

Article 2 — Acceptance

Use of the service implies full and unreserved acceptance of these Terms. By creating an account or using the service, the user acknowledges having read and accepted them.

Article 3 — Access to the service

The service is available free of charge, subject to an internet connection and a compatible device, the costs of which remain the user's responsibility. The publisher may change, suspend or discontinue all or part of the service for maintenance or product reasons, without incurring liability.

Article 4 — User account

Creating an account may be required to access certain features. The user agrees to provide accurate information and to keep their credentials confidential. The service is reserved for people aged 15 or over, in line with the age of digital consent in France.

Article 5 — Service description and skin profile

The skin profile (depth, undertone, skin type) and the matches suggested are indications intended to make choosing easier. They constitute neither dermatological advice nor a guarantee of results. Product information (shades, prices, availability) is provided for information only and may vary.

Article 6 — User-generated content

The user is solely responsible for the reviews, comments and content they publish. They undertake not to post any content that is unlawful, misleading, defamatory or infringing on third-party rights. By publishing, they grant the publisher a non-exclusive licence to use the content for the operation and promotion of the service. The publisher may moderate or remove any content that breaches these Terms.

Article 7 — Personal data

The processing of personal data is described in the privacy policy, in accordance with the GDPR. Certain data (including the skin profile) may qualify as sensitive data processed on the basis of the user's consent.

Article 8 — Intellectual property

All elements of the service (brand, logo, interfaces, texts, databases) are protected and remain the property of BeBranded SAS. No reproduction is permitted without prior written consent.

Article 9 — Affiliate links and third-party brands

The service may contain outbound links to retailers, including affiliate links that may generate a commission. These links do not make the publisher liable for third parties' prices, availability or terms of sale.

Article 10 — Liability

The publisher uses reasonable means to ensure the accuracy of the information, without warranting that it is error-free or continuously available. It cannot be held liable for purchasing decisions, user reviews, or indirect damages arising from use of the service.

Article 11 — Changes to the Terms

The publisher may amend these Terms at any time. Users are informed of substantial changes; continued use constitutes acceptance of the version in force.

Article 12 — Governing law and disputes

These Terms are governed by French law. In the event of a dispute, an amicable solution will be sought before any legal action; failing that, the competent courts will be those of the publisher's registered office (Bobigny), subject to consumer-protection rules that may apply.
